1. Provider Position
WaikikiElectricians.com is limited to a maximum of two participating electrical service providers: Position 1 and Position 2. The provider receives only the position selected and purchased. Position 1 displays first and Position 2 displays second. Both positions receive the same provider features and pricing. Neither position grants category or territorial exclusivity. No additional provider position will be added while the two-provider maximum remains in effect.
The selected position may not be sold to another provider while this agreement and required payments remain current. The provider may not automatically switch positions. A change may occur only when the other position becomes available and Waikīkī Aloha LLC approves the change.
2. Term, Payment & Renewal
The initial minimum term is six months and is paid in full at onboarding in the amount of $360. Following the initial prepaid term, the placement automatically renews month-to-month at $60 per month unless cancelled with at least 30 days’ written notice.
The initial six-month payment is nonrefundable after the provider has been approved and the selected position activated. Recurring monthly payments are nonrefundable once processed. If licensing, insurance, identity, or material business information cannot be verified and the application is declined before activation, the placement payment will be refunded.
3. Direct Customer Contact; No Commission
Calls, text messages and emails generated through WaikikiElectricians.com are directed straight to the provider using the contact details supplied by the provider. Waikīkī Aloha LLC does not answer, screen, qualify, distribute, manage or guarantee enquiries. No commission is charged on work obtained through the listing. The provider retains all revenue earned from its customers, subject to the provider’s own taxes, expenses and obligations.
No minimum number of calls, messages, enquiries, estimates, customers, bookings, contracts, jobs or revenue is promised or guaranteed.
4. Provider Responsibility
Waikīkī Aloha LLC and WaikikiElectricians.com do not perform electrical services and are not parties to any estimate, appointment, contract, payment, repair, installation, warranty, dispute, injury, property damage, or other transaction between the provider and a customer. The provider is solely responsible for its services, pricing, scheduling, workmanship, employees, subcontractors, licensing, insurance, permits, materials, warranties, taxes, customer service, collections, claims and legal compliance.
The provider is responsible for handling customer complaints and disputes directly and promptly.
5. Listing Information & Updates
Waikīkī Aloha LLC may edit, format, shorten or reorganize submitted listing information for clarity, consistency, accuracy, design or visitor usability without intentionally misrepresenting material facts. The provider may request reasonable updates to its business name, preferred public contact, call/text/email information, website, logo, service descriptions and availability. The provider must promptly report changes in contact information, licensing, insurance, ownership, availability or other material business details.
6. Verification, Suspension & Removal
Publication is subject to verification of licensing, insurance and submitted business information. Waikīkī Aloha LLC may request clarification or corrections before publication. A listing may be suspended or removed for expired or unverifiable licensing or insurance, failed or overdue payment, materially false or misleading information, repeatedly failing contact details, cessation of Waikīkī service, serious safety/legal/fraud/professional-conduct concerns, material breach, or other circumstances reasonably threatening platform integrity or public trust.
Correctable issues will normally receive notice and a reasonable opportunity to cure. Immediate suspension may occur for expired credentials, safety concerns, suspected fraud or serious legal issues. Provider-caused suspension does not pause the prepaid term or create a refund.
7. Termination & Released Positions
A provider that elects to leave during the initial six-month term receives no partial refund. After the initial term, cancellation requires at least 30 days’ written notice. When the agreement ends, Waikīkī Aloha LLC may remove the listing and make the position available to another provider.
If Waikīkī Aloha LLC terminates the agreement without provider fault, it may issue a fair prorated refund for unused prepaid placement time. No refund is required where termination results from nonpayment, expired credentials, false information, misconduct, safety concerns or another material breach.
8. Website Availability & Platform Ownership
Waikīkī Aloha LLC does not guarantee uninterrupted website availability, search-engine rankings, traffic levels, device compatibility or freedom from temporary technical errors, maintenance, hosting interruptions or third-party outages. Temporary interruption does not automatically entitle the provider to a refund, credit or extension.
WaikikiElectricians.com, its design, page structure, written content, branding, domain name, graphics and platform materials remain the property of Waikīkī Aloha LLC or their respective owners. The provider retains ownership of its business name, logo, photographs and supplied materials and grants Waikīkī Aloha LLC permission to display, resize, format, reproduce and promote those materials for the provider’s listing and related promotion within the Waikiki Media / Waikīkī Aloha LLC network during the agreement. The provider confirms that it has the right to supply all submitted materials.
9. Indemnification
The provider agrees to indemnify and hold Waikīkī Aloha LLC harmless from claims, losses, costs, liabilities or expenses arising from the provider’s services, conduct, staff, subcontractors, representations or material breach of this agreement, to the extent permitted by applicable law.
10. Governing Law & Notices
This agreement is governed by the laws of the State of Hawaiʻi. Any legal action arising from this agreement must be brought in an appropriate court located in Honolulu, Hawaiʻi, unless the parties agree otherwise in writing. Required notices may be delivered by email to the addresses supplied during onboarding. The provider is responsible for keeping its email address current.
11. Electronic Acceptance
By accepting this agreement, entering the authorized representative’s name, applying an electronic signature and completing payment, the provider confirms that it has reviewed and accepted the agreement and that the signer is authorized to bind the business.
